New Laws to Be Aware of:
- SB 1300 which lowers the bar on what constitutes “severe or pervasive” conduct that would trigger a legal claim for sexual harassment. It also prevents employees from having to sign a “release” to get a raise or as a condition of employment; prohibits non-disparagement agreements that keep employees from disclosing illegal acts.
- SB 820 which bars nondisclosure agreements in court settlements involving sexual harassment, assault, or discrimination unless the claimant requests confidentiality.
- California expanded sexual harassment training requirements, SB 1343 now mandates sexual harassment training to all non-supervisory employees. Specifically, employers will now be required to provide “at least one hour of classroom or other effective interactive training and education regarding sexual harassment to all nonsupervisory employees” by January 1, 2020, and once every 2 years thereafter.
